Please read these Terms of Use (“Terms”) carefully. By accessing or using the Services of Protocol8 or the Game you agree to be bound by these Terms. If you do not agree, you must not use the Services.

1. Definitions

“Services” means the DEX Service (protocol8.io) and/or the Game Service (game.protocol8.io) and any associated website, mobile application, smart contracts, APIs or other content and functionality. “User”, “you”, “your” means any individual or entity accessing or using the Services. “Account” means your user account registered with us. “Wallet” means any blockchain wallet or address you link or use to interact with the Services. “Virtual Assets” means crypto tokens, in-game tokens, NFTs or other digital items offered or used through the Services. “Content” means any text, graphics, images, software, audio, video, or other materials available through the Services.

2. Acceptance of Terms

When you access or use the Services, you accept and agree to these Terms and our Privacy Policy. If you act on behalf of a company, you represent that you have authority to bind that company.

3. Eligibility

You must be at least the minimum legal age in your jurisdiction (generally 18+ unless otherwise specified) and have full legal capacity to enter into these Terms. If you are using the Services on behalf of a minor, you accept responsibility for compliance.

4. Account Registration

You may be required to register and create an Account, provide accurate and complete information, and maintain security of your credentials and wallet(s). You are responsible for all activity occurring under your Account and/or wallet. Notify us immediately of any breach or unauthorized use.

5. User Conduct

  • Use the Services for lawful purposes and comply with all applicable laws.
  • Do not interfere with or disrupt the Services or related networks.
  • Do not use bots, scripts, hacks or cheats to manipulate the Game or DEX.
  • Do not post unlawful, fraudulent, abusive, defamatory, or obscene material.
  • Do not attempt to obtain or access other users’ accounts or wallets.
  • Do not engage in money-laundering, terrorism financing, or illicit financial behavior.
  • Do not transfer Virtual Assets or use the Services in a way that circumvents or compromises controls.

6. Licence and Access

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Services for your personal and non-commercial use, unless otherwise agreed. We reserve all rights not expressly granted.

7. Virtual Assets and Game Mechanics

Your access to and use of Virtual Assets via the Services are subject to the rules of those Virtual Assets and applicable terms. We do not guarantee that any reward, token or in-game item will retain value or may be traded. You accept full risk related to blockchain networks, tokens and game features.

8. Fees and Payments

If any fees apply for use of the Services, they will be specified on the Service. All payments must be made in an accepted manner. You are responsible for any taxes or duties arising from your use of the Services.

9. Intellectual Property

All Content, trademarks, trade names, service marks, logos, and other intellectual property displayed through the Services are owned by us or our licensors. You shall not copy, reproduce, distribute, display or create derivative works without prior written consent. If you submit user-generated content, you grant us a worldwide, royalty-free, sublicensable, transferable licence to use it in connection with the Services.

10. Termination and Suspension

We may suspend or terminate your access to the Services at any time for any reason, including breach of these Terms or fraudulent/abusive behavior. Upon termination your license ends and we may delete or anonymise your data, subject to legal obligations.

11. Disclaimers and Limitation of Liability

The Services are provided “as is” and “as available” without warranties of any kind. To the maximum extent permitted by law, we shall not be liable for indirect, incidental, special, punitive or consequential damages, loss of profits, data, or goodwill arising from your use or inability to use the Services.

12. Indemnification

You agree to indemnify and hold harmless Protocol8 and its affiliates from any claims, losses, or expenses arising out of your violation of these Terms, your use of the Services, your breach of law or third-party rights, or your UGC/wallet interactions.

13. Changes to the Services or Terms

We may modify, suspend or discontinue the Services at any time and update these Terms from time to time. Material changes will be notified. Continued use after the effective date constitutes acceptance.

14. Severability

If any provision is held invalid, the remaining provisions will remain in full force and effect.

15. Entire Agreement

These Terms, together with the Privacy Policy and any other posted policies, constitute the entire agreement between you and Protocol8 regarding the Services.
